Terms and Conditions
The Warranty Period shall be one year for equipment and installation by Interceptor Technology Group, LLC (ITG) from the date of completion. Batteries are warranted for 90 days from date of installation. Vandalism, misuse or acts of God,fire, lightning, wind, and other such events are not warranted by ITG.; any accidental or other damage by any persons or vehicles is not covered under the this warranty. ITG(Company) MAKES NO EXPRESS OR IMPLIED WARRANTIES AS TO ANY MATTER WHATSOEVER, INCLUDING WITHOUT LIMITATION THE CONDITION OF THE EQUIPMENT, ITS MERCHANTABILITY OR ITS FITNESS FOR ANY PARTICULAR USE. COMPANY DOES NOT REPRESENT NOR WARRANT: THAT THE ALARM SYSTEM HEREIN DESCRIBED MAY NOT BE COMPROMISED OR CIRCUMVENTED; OR THAT THE SYSTEM WILL PREVENT ANY LOSS BY BURGLARY, HOLD UP, FIRE OF OTHERWISE; OR THAT THE SYSTEM WILL IN ALL CASES PROVIDE THE DETECTION FOR WHICH IT IS INTENDED. SUBSCRIBER ACKNOWLEDGES AND AGREES: THAT COMPANY IS NOT AN INSURER; THAT THE SUBSCRIBER ASSUMES ALL RISK OF LOSS OR DAMAGE TO SUBSCRIBER’S PREMISES OR THE CONTENTS THEREOF; THAT ANY AFFIRMATION OF FACT OF PROMISE MADE BY COMPANY SHALL NOT BE DEEMED TO CREATE AN EXPRESS WARRANTY; THAT SUBSCRIBER IS NOT RELYING ON COMPANY’S SKILL OR JUDGEMENT IN SELECTING OR FURNISHING A SYSTEM SUITABLE FOR ANY PARTICULAR PURPOSE; THAT THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THOSE ON THE FACE OF THIS AGREEMENT.
Labor costs not included in this project bid shall require a change order. A change order will result in charges for parts and labor. The change order labor rate shall be charged at a rate of $105.00 per hour during normal business from 08:00 to 17:00 Monday through Friday except for Federal Holidays. Labor rate outside of normal business hours shall be $157.50 per hour. Change orders require written, signed approval by the customer. Any service not covered under Warranty or Service Plan is charged at $105.00 per man-hour with a minimum charge of two (2) hours.
ITGdoes not provide cutting, patching, painting, resurfacing of any wall, floor, ceiling, or other finished surfaces, boring, underground trenching, work on any high voltage electrical circuits (above 70 volts), or coring of any kind. Aerial lifts are not included unless otherwise specified.
The Customer will provide all AC power, telephone service, electrical bonding, cooling fan /HVAC requirements, back-up power supplies, "IT" networking specialist when on-site networking connections are required. ITG will not be held responsible for delays, equipment substitutions, or contingencies that are beyond its control. Equipment description and technical layout may be provided at customer's request. Technical layouts, shop drawings and design specifications are the intellectual property of ITG.
Client shall indemnify, defend and hold harmless ITG, its affiliated companies, and their officers, directors, employees, agents representatives, invitees, contractors and subcontractors ("Intercreptor Technology Group”) from and against any and all claims, losses, damages, expenses, judgments, awards, costs and charges of any kind, including attorney’s fees and expenses, all claims, direct or indirect arising out of, or related to the subject matter or performance of this Agreement which claims are caused by or result from negligence of ITG (whether sole or concurrent, active or passive, simple or gross) or other legal fault including strict liability of ITG and agree to other terms and conditions as set forth in this Commercial Agreement.
ITG shall perform contracted inspections in accordance with applicable State and Local rules set forth by the authorities having jurisdiction. Inspection and testing resulting in deficiencies shall be the responsibility of the customer to have repaired by a licensed company within the time specified by the Authorities Having Jurisdiction. ITG shall not be held liable for damages resulting from deficiencies noted during inspection and testing conducted by ITG, or any other entity. ITG shall not be held liable for damages resulting form the repairs or modifications to the customer's systems by any other individual or entity.
SUBSCRIBER’S OBLIGATION: Subscriber agrees to properly set and operate the system during closed periods and to carefully
test the system daily. In the event of a defect in the system Subscriber shall notify Company and Company will repair defective
conditions as soon as reasonably possible under the warranty terms set forth in this agreement.
TERMS: Terms of this agreement are COD unless an account has been previously established and the purchase amount has not
exceeded the credit limit of Subscriber. Charged purchase are NET 10 days and will be considered late after 20 days in which a late
charge may be assessed in the amount of 2.5% monthly. Returned checks will be assessed a $15.00 fee.
